 Any disputes arising between NH and the Buyer may be settled out of court.

11. Purchases, Exchanges, Cancellations, Returns, and Additional Terms

1. In purchasing any Products from Sellers via the Website, Buyers agree to comply with the following:

1. As a Buyer, you have exclusive and sole responsibility overall aspects of due diligence relative to a purchase of any Products, including any Seller terms, and Seller-specific details and descriptions.
2. As a Buyer, you agree and acknowledge that you are acting on your own behalf,and that NH is not a party to any subsequent purchase/sale/re-sale contract for the Products;

iii. As a Buyer, you further agree and  acknowledge that NH does not represent you or Seller at any stage of your order for Products with the Seller;

1. Products that are offered for sale via the Website are made-to-order for each Buyer by the individual Sellers. Accordingly, the following applies to refunds and returns for any Products purchased by a Buyer:

1. Orders for Products may be cancelled by the Buyer within twenty-four (24) hours from the time of purchase (“ 24 Hour Cancellation Period”) for a refund of funds paid to the Buyer’s original payment method (except processing and transaction fees). NH must receive the cancellation request within the 24 Hour Cancellation Period - no exceptions can be made. The following terms apply after the 24 Hour Cancellation Period:
1. Dolls is a custom product that is created exclusively for Buyer. After the 24 hour period, an order will be processed and cannot be cancelled for any reason.
2. NH will confirm order details via email with Buyer, if Buyer confirms the order details as correct, starting from that moment the order cannot be returned or cancelled for any reason. If Buyers want to edit, modify or upgrade the order he has to reach out NH asap in order to request the changes and to check if the changes are possible.
3. If for exceptional reasons the cancellation is accepted by Seller after the 24 Hours Cancellation Period. The cancellation will be subject to a Seller’s restocking fee (“ Restocking Fee”) of twenty percent (20.0%) from the Product order value. NH will provide to Buyer a refund of funds paid minus the Restocking Fee to the Buyer’s original payment method and other fees may apply such as transaction and processing fees.
4. Other fees may apply such as transaction and processing fees when refunding or returning funds. Depending on the used payment method.
2. In case the Product is marked as “custom made", NH will send the Buyer at the same time as accepting the order photographs of ordered Product from production. The Buyer is obliged to approve the appearance of the Product within 3 days, or state how the Product differs from his order. In the event that Buyer does not approve the Product within specified period nor state how the Product differs from the original order, it shall be considered that Buyer has approved the appearance of the Product. The Buyer acknowledge that after the approval of the Product, it is no longer possible to make any modifications to the Product and it is not possible to withdraw from the purchase agreement.

Except for cases referred to in article above or cases where withdrawal from the purchase agreement od products is not possible (1837 of the Act No. 89/2012 Coll. Civil code e.g. delivery of goods adjusted as per the requirements/for the needs of the Buyer; delivery of fast moving consumer goods or goods irreversibly mixed with other goods after delivery; delivery of goods in a sealed packaging removed by the consumer whereby such goods cannot be returned for sanitary reasons), the Buyer is entitled, in accordance with the provision of Section 1829(1) of the Act No. 89/2012 Coll. Civil code, to withdraw from the purchase agreement within fourteen (14) days after acceptance of goods; in the event the subject matter of the purchase agreement is several types of goods or the delivery of several parts, this period shall commence on the date of the last goods delivery acceptance. The notice on withdrawal from the purchase agreement shall be sent to the Seller before the deadline specified in the previous clause. In the event of withdrawal from the purchase agreement under this article, the purchase agreement shall become null and void. The goods shall be returned to the Seller within fourteen (14) days after the agreement withdrawal. If the Buyer withdraws from the purchase agreement, the Buyer shall bear any costs related to returning the goods to the Seller. The product has to be returned clean, undamaged and unused, in order for the money to be refunded to the customer.

iii. THE SALE IS FINAL, after a Product is shipped to Buyer, and it cannot be cancelled or returned for any reason, except due to a defect in accordance Section 11.

1. If you receive a Product that is damaged or with features or components that are missing, you must notify NH of the damage or missing component/feature within three (3) calendar days of the delivery. NH and the Seller may request additional information from you, including descriptions and pictures of the damage and/or missing items to evaluate the claim, and you agree to provide the requested documents.Upon review, the Seller shall have the exclusive and sole right to accept or decline the claim for damage or missing features/components. The Buyer is obliged to check immediately upon receipt whether the Product is intact and to document any deficiencies with a photo or video. In the event of breach of the packaging of the consignment, the Buyer is obliged to resolve this issue with the carrier and shall also document such deficiencies with photo or video. If the Seller accepts your claim, it shall have the right, at its sole option, to provide either: i) the missing features or parts; ii) a repair to the Product; iii) a replacement of the Product; or iv) a money refund actually paid by you for the Product.

1. If you receive a Product with a manufacturing defect, you must notify NH within three (3) calendar days of the delivery. In the case of a latent defect of a Product, you must notify NH within three (3) calendar days of your initial discovery. Replacement or repair of any defective product shall be in accordance with the warranties and policies of the Seller responsible for the Product. The Buyer acknowledge that the defect of the Product is not a change in the colors of the Product or gradually changing colors of the Product. The Products or some parts of it may be subject to changes in the color over time, due to use or due to external factors (e.g. sunlight, liquids, etc.). Likewise it is not a defect of the Product if the color of the Product is not fundamentally different from the color of the Product presented on the Website. The Buyer acknowledges that all photographs of the Products on the Website are for illustrative purposes only.

1. The Buyer is exclusively and solely responsible for all taxes, fees and duties, that may be levied upon any Product at the time of delivery by the government of the destination country,state,  province, region or territory to where the Product is shipped. NH and the Seller may request additional information from you, including descriptions and pictures of the defect to evaluate the claim, and you agree to provide the requested materials. Upon review, the Seller shall have the sole and exclusive right to accept or decline the defect claim. If the Seller accepts your claim, it shall have the right, at its sole option, to provide either: ii) a repair to the Product; iii) a replacement of the Product;or iv) money refund actually paid by you for the Product.

1. For all Product repairs or replacements that did not result from a manufacturing defect, Buyer shall be responsible for all shipping costs.

1. If the Seller agrees to accept a return of any Product for any reason, NH shall not be responsible for any shipping costs associated with such return of Product. Unless the Seller specifically agrees to pay for shipping costs of a returned Product, the Buyer shall be solely responsible for such cost of return.
2. Each Seller and Product may have its own, additional policies and rules for order cancellations, Products exchange, Products return and for Products refunds that are different from the other Products offered via the Website. Any additional or differing terms shall be displayed with the Product description. As a Buyer, you agree to comply with the specific terms set forth by a Seller in connection with its any Products it sold.
3. As a Buyer, you agree and acknowledge that NH reserves the right to reject any order that you make via the Website (or to transmit any order to the respective Seller) for any reason. If we reject or cancel an order that you have placed via the Website, we will attempt to notify you by contacting you via the information provided in your Account or information provided at the time your order was made.

• Geographic Restrictions

NH owns the Website and is based in Czech republic. If the relationship established by the purchase agreement includes an international (foreign) element, the Seller and Buyer stipulate that such relationship shall be governed by Czech law. This is without prejudice to any consumer rights resulting from the generally binding laws and regulations. Access to the Website may not be legal by certain persons or in certain countries. NH reserves the restrictive right to limit the countries from which Buyers can purchase the Products through the Website. Each Seller has the right to refuse any orders from any Buyer.

• Disclaimer of Warranties

• User understands that NH cannot and does not warrant or guarantee that content AVAILABLE from the Website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection.
